Consumer Health Data Privacy Policy
1. About this policy
This policy applies in addition to our Privacy Policy. It explains how Outlaw Liberations LLC, 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, USA (“we”), handles “consumer health data” as defined in the Washington My Health My Data Act and similar laws of Nevada, Connecticut and other states. We apply it to all users, wherever they live.
2. What we collect and why
SpearBreath works with data that can say something about your health: breath-hold times and personal bests, the time of your first contraction, how a session felt, and dive-log details such as depths, dive times and incidents (for example a samba or a blackout).
On your device, the app uses this data to plan and adjust your training and to show your progress. As long as it stays on your device, we do not receive it.
Training backup: only with your consent, we store this data in your account so you can restore it on other devices.
Community profile: only if you switch it on, your deepest dive, trophy fish and breath-hold personal best are shown on your profile to other members.
Posts and messages: whatever you choose to write about yourself.
We do not infer or derive health information about you, do not use consumer health data for advertising, do not collect precise location and do not use geofencing.
3. Where it comes from
Only from you: what you enter in the app, and what the app’s timer measures while you train.
4. Who receives it
Supabase Inc. (supabase.com), our hosting provider, stores your training backup and the profile values you choose to show, on our behalf and only on our instructions.
Other signed-in members see the profile values you choose to show (deepest dive, trophy fish, breath-hold personal best) and what you post.
DeepL SE (deepl.com) receives the text of a post if a member asks for a translation of it; it deletes the text after translating it.
We share consumer health data with no one else, and we never sell it.
5. Your consent
We collect consumer health data on our servers only with your consent, which you give separately for the training backup and for each profile value, or as far as necessary to provide something you asked for. You can withdraw your consent at any time – in Settings › Back up training or when editing your profile. We then stop collecting the data and delete it from our servers.
6. Your rights
You have the right to confirm whether we collect, share or sell your consumer health data; to access it, including a list of all third parties and affiliates with whom we have shared it and how to contact them; to withdraw your consent; and to have your consumer health data deleted, also at our service providers.
How: in the app (Settings › Export my data, Back up training, Delete account) or by email to support@spearbreath.app with the subject “Health data”. We respond within 45 days; if necessary, we may extend this period once by 45 days and tell you why. Backup copies are overwritten within 30 days.
If we decline your request, you can appeal by replying with the subject “Appeal”. We decide within 45 days. If we deny your appeal, you can contact the Washington State Attorney General (atg.wa.gov) or the attorney general of your state.
We never treat you differently for using these rights.
7. Contact and changes
